Important Information About This Legal Contract

Buyer agrees to the terms and conditions outlined in this Online Contract ("Contract") with respect to the goods, services and information provided by or through the Site. This Contract constitutes the entire and only agreement between SIBERIAN PRODUCTS (the "Company") and Buyer, and supersedes any and all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the goods, services and information provided by or through the Site, and the subject matter of this Contract. Buyer agrees to review this Contract prior to purchasing anything and purchase of a good or service shall be deemed acceptance of this Contract.

Setup and Payment

Buyer represents and warrants that (i) the credit card information supplied is true, correct and complete and (ii) charges incurred by the Buyer will be honored by the Buyer's credit card company and (iii) Buyer shall pay charges incurred by Buyer at the amounts in effect at the time incurred, including all applicable taxes. Buyer shall be responsible for all charges incurred through use of Buyer's password. Buyer agrees to keep his or her password confidential and to notify Company within 24 hours of any breach of this Contract or unauthorized use of the password. Company does not protect Buyer from unauthorized use of Buyer's password.

Copyright

The content, organization, gathering, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights, and, the copying, redistribution, use or publication by a Buyer of any such content or any part of the Site is prohibited.

Editing, Deleting, and Modification

Company reserves the right in its sole discretion to edit or delete any information or content appearing on the Site. Upon notice published over the Service, Company may modify this Contract and may discontinue or revise any or all aspects of the Site in its sole discretion and without prior notice. Modification of this Contract will be deemed effective upon publication on the Site with respect to transactions occurring after said date.

Right to Refuse

Company reserves the right in its sole discretion to refuse service at any time. Sale of any goods or services is subject to availability.

Indemnification

Buyer agrees to indemnify, defend and hold Company and its affiliates, licensors and suppliers harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to a Buyer's violation of this Contract or use of the Site.

Non-Transferable

Buyer's right to use the Service is not transferable and is subject to any limits established by Company or by Buyer's credit card company.

Disclaimer

THE SERVICE, CONTENT, GOODS AND SERVICES FROM OR THROUGH THE SERVICE ARE PROVIDED "AS-IS," "AS AVAILABLE," AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE). THE SOLE AND ENTIRE MAXIMUM LIABILITY OF COMPANY, FOR ANY REASON, AND BUYER'S SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE AMOUNT PAID BY THE CUSTOMER FOR THE PARTICULAR ITEMS PURCHASED. COMPANY AND ANY OF ITS AFFILIATES, DEALERS OR SUPPLIERS ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LITIGATION, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN COMPANY AND BUYER. THIS SITE AND GOODS AND SERVICES WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS.

Pricing and Information Disclaimer

All pricing subject to change. For all prices, products and offers, SIBERIAN PRODUCTS reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements and other extenuating circumstances.

While SIBERIAN PRODUCTS uses reasonable efforts to include accurate and up-to-date information on the Site, the Company makes no warranties or representations as to the Site's accuracy. SIBERIAN PPRODUCTS assumes no liability or responsibility for any errors or omissions in the content on the Site.

Third-Party Products

All third party products sold by SIBERIAN PRODUCTS are subject to the warranties and representations of the applicable manufacturers.

Title; Risk of Loss

Title to goods herein being purchased is retained by the seller until goods are paid for by the purchaser and at that time title passes to the purchaser. Loss or damage that occurs during shipping by a carrier selected by SIBERIAN PRODUCTS is the Company's responsibility.

Orders; Payment Terms; Interest; Taxes

Orders are not binding upon SIBERIAN PRODUCTS until accepted by SIBERIAN PRODUCTS. Terms of payment are within the company's sole discretion. Invoices are due and payable within the time period noted on the invoice, measured from the date of the invoice. SIBERIAN PRODUCTS may invoice parts of an order separately. Customer agrees to pay interest on all past-due sums at the highest rate allowed by law. The Customer is responsible for sales and all other taxes associated with the order.

Delivery

All products sold by SIBERIAN PRODUCTS are brand new. Products become the sole property of the Buyer upon delivery to the specified shipping agent and thereafter all risk of loss or damage shall be upon Buyer. All in stock products are shipped within 3 business days of receipt of your order.

Delivery dates given in advance of actual shipment of goods or performance of services are estimates and shall not be deemed to represent fixed or guaranteed delivery dates. Unless otherwise noted, a standard shipping charge is applied to each invoice for goods for material preparation, packaging, freight and/or any additional items associated with each shipment based on the value and/or weight of the shipment. Additional charges for local delivery may also apply.

For shipping damage, customers should file claim to their carrier immediately. Any discrepancy, including wrong items or missing items, should be reported to SIBERIAN PRODUCTS within 24 hours at support@siberianproducts.com. Because of the nature of the Internet, online ordering your purchase from SIBERIAN PRODUCTS acknowledges that you have read and agree to these terms and conditions. All brands and product names mentioned are trademarks and/or registered trademarks of their respective holders.

Force Majeure

SIBERIAN PRODUCTS SHALL NOT BE RESPONSIBLE FOR ANY FAILURE TO DELIVER OR FOR DELAY IN DELIVERY OR PERFORMANCE DUE TO CIRCUMSTANCES BEYOND ITS REASONABLE CONTROL, INCLUDING, WITHOUT LIMITATION, ACTS OF GOD, WAR, RIOT, EMBARGOES, ACTS OF CIVIL OR MILITARY AUTHORITIES, FIRE, FLOODS, ACCIDENTS, SERVICE OUTAGES RESULTING FROM EQUIPMENT AND/OR SOFTWARE FAILURE AND/OR TELECOMMUNICATIONS FAILURES, POWER FAILURES, NETWORK FAILURES, FAILURES OF THIRD PARTY SERVICE PROVIDERS (INCLUDING PROVIDERS OF INTERNET SERVICES AND TELECOMMUNICATIONS AND CARRIERS). THE PARTY AFFECTED BY ANY SUCH EVENT SHALL NOTIFY THE OTHER PARTY WITHIN A MAXIMUM OF FIFTEEN (15) DAYS FROM ITS OCCURENCE. THE PERFORMANCE OF THS AGREEMENT SHALL THEN BE SUSPENDED FOR AS LONG AS ANY SUCH EVENT SHALL PREVENT THE AFFECTED PARTY FROM PERFORMING ITS OBLIGATIONS UNDER THIS AGREEMENT.

Return Policy

No product will be accepted for return, once ordered.

However, if your purchase is damaged in transit we will send you a "no charge" replacement, freight free or give you full credit or a refund for the price of the product exchanged by your original payment method. If merchandise arrives damaged:

  1. Save the merchandise AND the original box and packing it arrived in;
  2. Notify SUBERIAN PRODUCTS' Returns Department at returns@siberianproducts.com immediately for further instructions. For faster service, please provide our Returns Department with the following information: customer name, invoice number and nature of the problem.

If you do not notify SIBERIAN PPRODUCTS of damaged goods within the first 7 days of arrival, our regular return policy will override any claim of damage.

Back-order Policy

When you place an order and some items are not in stock, we put them on back order for you. If you order an out-of-stock product from us, we will email you when we expect that product to be available. You will be among the first to receive the item. If we back order for you, we will not charge for the second delivery. No additional shipping and handling charges will be added when your order ships. Products on back-order will be shipped using the shipping method you chose. If you would like to change your shipping method, please send email to support@siberianproducts.com and we will change it for you.
